A. A permit may be granted only if the City determines that the applicant:

1. Has submitted a complete application;

2. Has submitted satisfactory proof that it will comply with the provisions of this chapter;

3. Has not made any omission or untrue statement, or provided any fraudulent documentation in connection with the application;

4. Has not violated this chapter two or more times within the last three years; and

5. Is not otherwise subject to suspension or revocation under this chapter.

B. The City may deny a permit if it determines that the applicant or any of its officers or directors:

1. Has been convicted of any public offense involving violation of laws related to gambling, fraud, tax evasion or similar offenses; or

2. Has lost any governmental permit or entitlement as the result of revocation.

C. Denial of a permit may be appealed as set forth in Section 9.18.160.

D. Permits issued shall be valid for a calendar year and shall expire December 31st of each year, except that permits for one-time bingo games shall expire at the conclusion of the event or activity as stated in the application.

E. Permits under this chapter are nontransferable.

F. Nothing in this chapter creates any property interest in issuance or renewal of a permit. (Ord. 7152-NS § 1 (part), 2010)
