Where the failure of any owner to comply with the requirements of this chapter results in injury to any person or damage to property, the injured person or the owner of the damaged property may bring a civil action for actual damages. In such cases the affected newsrack owner shall indemnify and hold the City harmless for any and all liability. (Ord. 6471-NS § 1(15), 1999)
