For the purpose of this chapter, certain words and phrases are defined and certain provisions shall be construed as set out in this section, unless it shall be apparent from the context that a different meaning is intended.

A. "Bakery" means any room, building or place used or operated for making, preparing or baking bread, cakes, pies, pastry, doughnuts, rolls, biscuits, crackers or other products of flour or meal to be sold for food to the public.

B. "Confectionery" means any room, building or place used or operated for the sale of packaged or bulk candy, nuts or similar articles of food.

C. "Food market" means any room, building or place used or operated for the sale or storage of prepackaged foodstuffs, frozen food, bulk-packaged food, fresh fruits and vegetables.

D. "Food processing establishment" means any room, building or place used or operated for the commercial packaging, freezing, drying, salting, compounding, slaughtering, cooking, mixing, bottling, canning or other processing or preparing of food, except those used for the production or processing of market milk or other fluid dairy products.

E. "Itinerant restaurant" means any restaurant operating from temporary facilities serving, offering for sale, selling or giving away food or beverages, and includes, but is not limited to, a restaurant where only wrapped sandwiches or other wrapped or packaged, ready-to-eat foods are served, and any mobile unit on which food is prepared and served.

F. "Meat and food market" means a combination of food market and meat market, as defined in this section, operated by one proprietor.

G. "Meat market" means any room, building or place used or operated for the sale of fresh or processed meat, fish or poultry for consumption on premises other than where sold.

H. "Public swimming pool" means a body of water used by people for swimming, diving, wading or recreational bathing and for instruction in swimming or diving, together with the decking, building, equipment and appurtenances related to such purposes. It includes all bathing places entirely artificial in construction, such as wading pools and pools used for swimming schools; commercial and community pools, pools at hotels, motels, resorts, apartment houses, clubs, parks, public and private schools and other public or semipublic places. It shall not include privately owned swimming pools located on property improved with a single-family residence and used only by the owner, their family or guests.

I. "Restaurant" means any coffee shop, cafeteria, short-order cafe, luncheonette, tavern, cocktail lounge, sandwich stand, soda fountain, private and public school cafeteria, or eating establishment, in-plant or employee eating establishment, and any other eating establishment, organization, club (including veteran’s club), boardinghouse, guesthouse, or political subdivision, which gives, sells or offers for sale, food to the public, guests, patrons or employees as well as kitchens in which food is prepared on the premises for serving elsewhere, including catering functions. The term "restaurant" shall not include itinerant restaurants, vending machines or vehicles, or cooperative arrangements by employees who purchase food or beverages for their own consumption and where no employee is assigned full-time to care for or operate equipment used in such arrangement, or private homes; nor shall the term "restaurant" include private clubs or other nonprofit organizations which purchase food or beverages for the consumption of their members and where no employee or member is assigned full-time to care for or operate equipment used in such arrangement.

J. "Vehicle" means any vehicle upon which food or beverage is displayed, sold or offered for sale at retail, or given away to the public, but not including bakery delivery vehicles which are used exclusively to carry bakery products in sealed packages.

K. "Vending machine" means any self-service device offered for public use which, upon insertion of a coin, coins or token, or by other means, dispenses unit servings of food or beverage, either in bulk or in package, without the necessity of replenishing the device between each vending operation, but not including devices dispensing peanuts, wrapped candy, gum or ice exclusively.
