The chief of environmental health and such persons as the chief may designate may arrest a person without a warrant whenever the chief or their designee has reasonable cause to believe that the person has committed a public offense in the presence of the chief or their designee which is a violation of any statute or ordinance which the chief is empowered to enforce. In any case in which a person is arrested pursuant to the provisions of this title and the person arrested does not demand to be taken before a magistrate, the chief or their designee shall prepare a written notice to appear and release the person on such person’s promise to appear as prescribed by Penal Code Section 853.6.
