The City of Berkeley does hereby adopt the Supplementary Retirement and Income Plan III (the "plan"), effective as of January 1, 2005. The plan is a spin off of the assets and liabilities attributable to employees represented by the Berkeley Police Association ("police employees") participating in the City of Berkeley Supplementary Retirement and Income Plan II on or about December 31, 2004.
